Minimum Wage Requirements

The minimum wage depends on the company sector, for Deel is F.CFA 64,728 per month.

Individual Income Tax

Personal income tax (PIT) ranges from 0% to 43%. Income tax is calculated according to progressive rates. The category of salaries, wages, allowances, emolument, and benefits in kind constitute employment income.

Payroll Cost

The employer cost is generally estimated to be 24-28% of the employee's salary. This cost depends on the employee's category, determined by factors such as their monthly salary and qualifications. The category is confirmed during the onboarding process.

Overtime Pay & Maximum Hours

Standard working hours are 8 hours per day, 40 hours per week. The standard work week is from Monday to Friday.

Overtime payment is mandatory. Hours outside of standard work hours are considered overtime. For additional hours, employees are paid:

  • 115% of the hourly rate, the first 8 hours of the week
  • 140% of the hourly rate, the following the 48th hour of the week
  • 160% of the hourly rate, if the additional hours are night shifts 
  • 200% of the hourly rate, if falls in a weekend or public holiday
  • 260% of the hourly rate, for night shifts on public holidays

Maternity Leave

Employees, who have worked for 180 consecutive days are entitled to 14 weeks of paid leave. The employee will receive 100% of the salary during this period, and Social Security will be responsible for this pay.

The employee can extend leave additional 3 weeks under specific conditions approved by the doctor.

Paternity Leave

There is no paternity leave currently required by law.

Parental Leave

Female employees are entitled to 1 calendar day of parental leave per year until the child turns 14 years old. 

Sick Leave

Employees are entitled to a minimum of one week of sick leave per year, with the actual entitlement depending on several factors. These include whether the illness is occupational or non-occupational, and the employee's tenure with the company.

Termination Requirements

Terminations in Senegal can be complex. There is no at-will termination for employers outside the probation period.

Compliant terminations include:

  • Voluntarily by the employee
  • By mutual agreement
  • Unilaterally by the employer based on:
    • probation period
    • objective grounds
    • disciplinary dismissal
    • performance due to unsuitability for the job
  • By expiration of the contract

Notice Period

Notice will depend on the category of the employee and the length of employment.

  • More than 6 months of service:
    • Managerial and similar positions: 3 months
    • Monthly paid employees: 1 month
    • Hourly paid employees: 8-15 days 
  • More than 2 years of service: 
    • Managerial and similar positions: 3 months
    • Monthly paid employees: 1 month
    • Hourly paid employees: 15 days 
  • More than 2 years of service: 
    • Managerial and similar positions: 3 months
    • Monthly paid employees: 1 month
    • Hourly paid employees: 1 month

Severance for Employees

Employees are entitled to severance pay after at least one continuous year of service, assuming no grave misconduct occurs. The severance amount, a percentage of the monthly wage, varies with the length of service: 25% annually for the first five years, increasing to 30% for the next five, and reaching 40% after ten years.

Paid Time Off

Both full-time and part-time employees are entitled to 24 working days of paid time off (PTO) a year. PTO accrues monthly at 2 days per month. Employees are eligible for annual leave after 12 months of work.

Onboarding

Onboarding takes 7 business days. Compliance documents must be completed 1 day before the start date.

Employment Contract Details

Contracts must be in French and can be bilingual. They must be in writing and signed by both parties. A contract must include:

  • Name
  • Start date
  • Length of the employment
  • Job description
  • Termination conditions
  • Category of the employee

Probation Period

The minimum probation period is 30 days, and the maximum probation period is 90 days. The length depends on the employee's category, which is determined during the onboarding process.

  • Managerial and similar positions: 90 days
  • Monthly paid employees: 30 days
  • Hourly paid employees: 8 days
