Minimum Wage Requirements

In Mauritius minimum wage is complex. The base minimum wage is MUR 10,200 per month. Additional minimum wages apply depending on the employee's years of service and sector.

Individual Income Tax

The individual income tax ranges from 5% to 15%. For incomes below MUR 650,000, the tax will be 10% and for salaries, over MUR 650,000 the tax rate will be 15%.

Employer Cost

The employer cost is generally estimated at 12% of the employee salary.

  • CSG - 6.0% 
  • HRDC (Human Resources Development Council) Levy - 1.5%
  • Portable Retirement Fund - 4.5%

Overtime Pay & Maximum Hours

Standard working hours are 9 hours per day, 45 hours per week. The standard workweek is from Monday to Friday.

Overtime payment is not mandatory and may be included in the salary. Hours outside of standard work hours are considered overtime. For additional hours, employees are paid:

  • 150% of the hourly rate, for any additional hours over 90 hours in two weeks.
  • 200% of the hourly rate, on public holidays.

Maternity Leave

Pregnant employees are entitled to 14 weeks of paid leave. 6 weeks must be taken before the child's birth. The remaining 8 weeks must be taken after the birth. The employee will receive 100% of their average salary during this period, and Social Security will be responsible for 50% and the employer the other 50%.

Paternity Leave

There is no paternity leave currently required by law.

Parental Leave

In Mauritius, no law covers parental leave. However, employees may be entitled to maternity leave and paternity leave.

Sick Leave

Employees are entitled to paid sick leave for up to 15 days. The employee must have worked for one year to be eligible. However, if the employee has not taken any absence before 6 months they are eligible for sick leave after 6 months of employment. Leave is paid at 100% by social security.

Termination Requirements

Terminations must respect complex rules and the rules of an employee’s employment country. The off-boarding is always handled by the Employer with the primary stakeholders. It may include ad-hoc fees as well as required or recommended steps on specific termination cases.

Terminations in Mauritius can be complex. There is no at-will termination in Mauritius for employers and termination must be done for just cause.

Compliant terminations include:

  • Voluntarily by the employee
  • By mutual agreement
  • Unilaterally by the employer based on:
    • Probation period
    • Objective grounds
    • Disciplinary dismissal
    • Performance due to unsuitability for the job
  • By the expiration of the contract

Notice Period

The minimum notice period is 1 month and can be increased if stated in the employment agreement.

Severance for Employees

In Mauritius, all employees who are terminated due to unfair dismissal are entitled to severance pay. Severance pay is decided upon in a disciplinary committee meeting.

To protect you from unforeseen financial risks arising from terminations, Deel applies a Severance Accrual to all employment agreements in this country.  Deel has extensive expertise in managing litigation risk globally and our Severance Accrual calculation is based on the prevailing common-law or statutory entitlements and local best practices. In the event your employee resigns or is not entitled to severance, all unused amounts will be returned to you.

Paid Time Off

Full-time employees are entitled to 22 working days of paid time off (PTO) a year. PTO accrues monthly at 1.84 days per month. Employees are eligible for full annual leave after 12 months of work. However, if the employee has no absence (including sick leave) in the first six months of employment, the employee is entitled to 1 day of PTO per month from months 7-12.

Part-time employees are entitled to the number of days a week worked divided by the number of days of the working week (5) times the number of days leave for a full-time employee (22).

Onboarding takes 5 business days. The documents must be completed one day before the start date.

Employment Contract Details

Contracts must be in English or French and can be bilingual. They must be in writing and signed by both parties.

A contract must include:

  • Name
  • Start date
  • Length of the employment
  • Job description
  • Termination conditions

Probation Period

Probation periods are not mandatory. The minimum probation period is 3 months and the maximum probation period is 6 months.
