Who qualifies for the EB-2 PERM visa?

To qualify for an EB-2 PERM visa, you must be sponsored by a US employer with PERM certification. You must also have a valid job offer from the employer based on your:

Advanced degree

The job for which you are coming to the US must require that you have a US baccalaureate or its foreign equivalent in your field. Per the USCIS, you must also have at least 5 years of post-baccalaureate experience in this field. You can prove this through the following documents:

  • An official academic record showing you have an advanced degree or
  • A foreign equivalent degree
  • Letters of recommendation from past and current employers demonstrating your experience

Exceptional abilities

You may also qualify for an EB-2 PERM visa if you have “a degree of expertise significantly” beyond what is common in the sciences, arts, or business. To demonstrate this, you must meet at least three of the following criteria:

  • Have a certificate, diploma, degree, or similar award in your field from a learning institution
  • Be a member of a professional association
  • Be licensed or certified to practice your occupation or profession
  • Show evidence that you have received remuneration that points to your exceptional ability
  • Have received recognition for your significant achievements and contributions to your field from a professional organization, your peers, or a government entity
  • Have at least 10 years of ongoing experience in your field

How do you apply for the EB-2 PERM visa?

The EB-2 visa application process involves three main steps:

Securing PERM Certification

Before filing a petition with the USCIS, a US employer must submit an application for PERM labor certification to the DOL. You do this by submitting Form ETA 9089.

The DOL may only approve your application if you have:

  • Sent the beneficiary a valid job offer
  • Included a wage offer equal to or greater than the prevailing wage in the given occupation
  • Confirmed that there are no qualified American workers for the job

To meet the third requirement, you must submit a job order to the State Workforce Agency (SWA) for at least 30 days. You must also advertise the job offer in a widely circulated newspaper on 2 consecutive Sundays and at least three other channels.

Filing Form I-140 (Immigrant Petition for Alien Worker)

Within 180 days of obtaining a labor certification, you can file Form I-140 with the USCIS. You must accompany this form with evidence showing that:

  • You have obtained labor certification
  • You can pay the promised wage
  • The beneficiary has an exceptional ability or advanced degree

Attending interviews

When the USCIS receives your petition, they will issue a receipt notice. The foreign worker may then be requested to appear for an interview or biometrics appointment.

If you (the beneficiary) receive this request, appear at the embassy or consulate responsible for EB2 visa processing in your country. The interview notice will contain all the information you need, including the date and location of your meeting.

How long must you wait for an EB-2 PERM visa?

The EB-2 PERM visa category takes less time to process than third- and fourth-preference employment-based visas. This is because fewer applicants meet the eligibility criteria.

However, the USCIS allows no more than 7% of these visas to go to one country. This means you may experience slower processing times in a populated region like India or China. That said, the time it takes to get your EB-2 PERM visa varies from case to case. The PERM certification stage lasts 180 days, but it could take up to a year if the employer is audited.

The petition stage typically lasts 6 months but can be sped up to 15 days with premium processing.
